StoreReady™ - for damage or loss

STOREREADY ADDENDUM

A copy of this addendum will be sent to you upon completion of this agreement.

This StoreReady addendum forms part of Our licence agreement and only applies if You (i) have elected to take up the StoreReady option and (ii) have declared to Us the total value of the Goods; and (iii) remain up to date with payment of the StoreReady charges.

1. Where in this Addendum We refer to the “Limited Liability Terms” We refer to the terms and conditions of Our licence agreement without the addition of this StoreReady Addendum. Where a claim is considered in accordance with the Limited Liability Terms then We may not be liable for the claim and if We are Our liability is likely to be limited.

2. StoreReady is optional. If You have not elected to take up StoreReady or where StoreReady otherwise does not apply, Our liability will continue to be as set out in accordance with Our Limited Liability Terms.

3. Where StoreReady applies We agree to provide a safe and secure facility and unit for storage of the Goods protecting them against:

fire, lightning, explosion, earthquake, storm and/or flood,

bursting and/or leaking pipes, ingress of water or other liquids,

aircraft or articles dropped from them,

moth or insect or vermin from an external cause,

theft, with forcible and violent entry to or from the storage facility or unit,

riot, strike or civil commotion, malicious damage,

impact by vehicles or railway rolling stock.

4. Where the Goods are physically lost and/or are damaged by one of these causes then Our liability under StoreReady is subject to the terms set out below. In all other cases Our liability shall be considered in accordance with Our Limited Liability Terms.

5. Where StoreReady applies to a claim for physical loss and/or damage then clauses 30 (a) and 30 (b)(ii) of the licence agreement will not apply.

6. It shall be Your sole responsibility to declare the full value of the Goods. We do not provide advice as to the value of Your Goods. Our liability under StoreReady shall under no circumstances exceed the value declared by You to Us on the licence agreement or as otherwise agreed by Us in writing. Where You require Us to accept liability for a value above GBP 250,000 or for any Goods with an individual value above GBP 100,000 this will only apply where We confirm Our agreement in writing and upon payment by You of any additional StoreReady charges.

7. If You have not declared the total value of the Goods, then in the event they are physically lost and/or damaged, Our liability to You under StoreReady will be reduced in the same proportion that the value declared bears to the actual value of the Goods.

8. We shall not be liable for the ﬁrst GBP 25 of the value of any claim for Goods lost and/or stolen.

9. Where any of the Goods comprise part of a pair or set, Our liability will be limited under StoreReady to the value of the actual item(s) physically lost and/or damaged and not for the value of the pair or set. We will not have any liability for any item(s) forming part of a pair or of a set not physically lost and/or damaged.

10. a) Where We are liable under StoreReady We may at Our option replace, repair and/or provide compensation. Any calculation and/or compensation shall be on a replacement as new basis provided:

(i) any replacement shall not be substantially better than the original; and

(ii) the Goods in question are not household linen or wearing apparel.

For all other Goods We will take into account the age, condition, quality, degree of use and consequent market value.

b) Where We are liable under StoreReady and the Goods lost and/or physically damaged are documents We can agree to pay compensation on the basis of reasonable reprinting, reissue and/or reconstitution costs.

11. Full details of any losses and/or damages must be notified to Us at the time of discovery or removal of the Goods from the facility/unit, whichever is sooner.

13. If You knowingly provide misleading or fraudulent information relating to loss or damage, We will not have any liability and this Addendum will be cancelled with no refund.

14. The StoreReady Addendum will not apply to the following types of Goods:

(a) Deeds, securities, money, coins, currency and bullion.

(b) Food or perishable items.

(c) Plants and living creatures.

(d) Data records (including memory devices).

(e) Combustibles, explosives, flammables and chemicals.

(f) Hazardous substances including asbestos.

(g) Firearms, weapons and ammunition.

(h) Lithium-ion batteries and related restrictions as detailed above.

(i) Illegal or unsafe items.

(j) Items of non-financial or unique value.

15. Our liability under StoreReady shall be limited:

(a) GBP 500 for stamps.

(b) GBP 10,000 for specified goods including furs, fine arts, wines and vaping equipment.

(c) GBP 10,000 for electronic items.

16. There will be no liability under StoreReady for loss or damage arising from:

(a) Leakage from containers.

(b) War, invasion or civil unrest.

(c) Acts of terrorism.

(d) Depreciation after repair.

(e) Your own acts.

(f) Contamination or hazardous exposure.

(g) Sonic pressure waves.

(h) Cyber or electronic system misuse.

(i) Communicable diseases and related impacts.

17. We shall not be liable for indirect losses such as loss of profits, goodwill or anticipated savings.

DECLINATION

If You sign to DECLINE StoreReady™, You understand that: • You are required to arrange insurance at Your own expense to cover the stated Maximum Replacement Value of the Property. • The insurance cover you provide must be valid from the date you move into our storage facility. • You must provide evidence of the insurance You have arranged within 7 days of Your Goods being placed into storage. You understand that if You fail to comply with this condition, You will be automatically enrolled into StoreReady™ and the StoreReady™ Charges will be added to Your next invoice.]

I confirm that my I do not wish to protect my effects under StoreReady™ with Fox Self Storage and that the goods are insured under a private policy that I will provide proof of.

• The customer has been shown the fire escape routes.

GENERAL HEALTH AND SAFETY

• The customer has been informed of the signing in / out procedure.
• The customer has been made aware of where to park / unload their vehicles.
• The customer has been informed of the hazard reporting procedure.
• The customer has been informed of the accident reporting procedure.
• The customer has been made aware of the WC location.
• The customer has been instructed on how to use the lift/s safely.
• The customer has been informed of restricted areas e.g. warehouse & mezzanines.
• The yellow line boundary system has been explained to the customer.
• The customer has been informed of potentially dangerous activities. E.g. fork-lift operations and lorry / vehicle movements.
• The customer has been made aware of items or substances prohibited for storage.
• All children under the age of 16 must be supervised by a responsible adult.
• If you arrange for third-party individual to visit your self-store unit, you must make them aware of all customer safety rules prior to their arrival at Fox Self Storage Ltd.
